These terms govern your use of the Photoindex website at photoindex.io ("the Site"), operated by David Brabyn Photo. By using the Site, you agree to these terms. If you do not agree, please do not use the Site.

About the Site

The Site provides information about Photoindex, a photo-archive service for independent photographers that is currently in beta. The Site lets you request early access. Requesting access does not create an obligation on our part to provide the service, and features, pricing, and availability described here may change before launch.

The Photoindex service

Use of the Photoindex product itself — once available to you — is governed by a separate service agreement presented at sign-up. These terms cover only your use of this marketing website.

Acceptable use

You agree not to:

• Use the Site in any way that breaks the law or infringes others' rights.
• Attempt to disrupt, overload, or gain unauthorized access to the Site or its underlying systems.
• Submit information that is false, or that is not yours to submit.

Intellectual property

The Site's content, design, text, and the Photoindex name and branding are owned by David Brabyn Photo and are protected by applicable intellectual-property laws. You may not reproduce or reuse them without permission. Photographs shown on the Site are used with permission and remain the property of their respective copyright holders.

Disclaimer

The Site is provided "as is," without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, error-free, or that the information on it is complete or current.

Limitation of liability

To the fullest extent permitted by law, David Brabyn Photo will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Site.

Governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.

Changes to these terms

We may update these terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Site after changes take effect constitutes acceptance of the revised terms.
